TERMS AND CONDITIONS

SHINE ART ACADEMY is operated by ShineArt Pty Ltd, hereon referred to as us/we/our (ACN: 614 353 945 / ABN: 74 614 353 945). All references to you include you and/or all other parents and/or guardians (as applicable) of a prospective student or students. By enrolling yourself or your child or children (hereon referred to as your child) into one of our classes you agree to the following terms. We reserve the right to amend these terms at any time and continued attendance by you or your child after such amendments will constitute acceptance of the amended terms by you.

 

CREATIVE KIDS VOUCHER NSW

As a registered provider for the Creative Kids program, you can redeem your voucher with us and let your child develop new visual art skills.

The Creative Kids voucher is issued by the NSW Government that you can apply through Service NSW every calendar year.

The $100 voucher can be used towards any Shine Art Academy term course or holiday program for Children and Young People in NSW.

The $100 voucher cannot be used towards the trial lessons or any program of Shine Art Academy which has value under $100.

Creative Kids vouchers will be redeemed after the full tuition fee paid, along with providing the voucher number, the full name, date of birth and the bank account details. As soon as the voucher claimed from NSW Government successfully, we will refund $100 to your appointed account.

 

CONDITIONS OF ENROLMENT AND PARTICIPATION

 

1.   Enrolment

We run art classes for the following age groups:

•  Junior Artist: 5 - 7 years old

•  Tone and Colour: 8 - 12 years old

•  Fine Arts Explorer: 8 - 12 years old

•  Skills and Talent: 8 - 12 years old

•  Young Professional Artist: 10 - 18 years old

•  Adults: Event based class please visit www.shineart.com.au for any upcoming events

 

Places in our courses are only confirmed upon full and upfront payment of the term fees. Towards the end of each term, you are reminded by email and WeChat to enroll for the following term. Your child’s place in the following term will only be confirmed upon full and upfront payment of the next term’s fees.

 

Class sizes are strictly limited to the numbers available, and due to the popularity of our classes we cannot reserve places. Any student who has not been enrolled online while there is availability will be unable to attend the course.

 

Please ensure you enrol your child in the correct age group. For example, if your child is almost 5, but age 4 at the time of booking, please do not enrol your child in the 5-7 age group. For the benefit of all students we are very strict about this.

 

We reserve the right to refuse admission or cancel the enrolment of any student who poses a disciplinary problem or disrupts other students, as not all of our teachers are qualified to manage students with behavioural disorders or students who are unwilling to participate in the scheduled coursework.

 

If your child needs an art therapy session, please let us know that we can schedule a 1vs1 session with a relevant teacher.

 

By accepting these terms and conditions you are agreeing to your child being supervised outside with Shine Art Academy for the lunch break during the School Holiday Program.

 

2  . Fees

Please contact us or visit the relevant course page on our website for current pricing.

 

Payment for tuition fees can be made online (with surcharge pay to the third party) via our website, which ensures that your child’s place is immediately confirmed upon payment. 

 

Or, payment for tuition fees can be made via online transfer, which your child’s place will be confirmed when we receive the payment. 

 

Or you can schedule with us for a cash payment at the end of each term for the next term’s payment. 

 

Please contact us for assistance if you experience difficulties while enrolling.

 

3.   Refunds & Transfers

Please consider your booking carefully before enrolling as we do not offer refunds once payment has been processed.  We can do class transfers subject to the time and vacancies.

 

4.   Trial classes 

We offer scheduled trial classes at a cost for potential students, please contact us if you would like to organise a trial class to help you determine if a course is suitable for your child.

 

5.   Classes

Courses are designed to be sequential, so we strongly recommend that students attend every class in order to understand and build on the content taught.

 

Students should arrive for their class within and no earlier than 10 minutes of the scheduled start time and should be picked up no later than 5 minutes after the conclusion of each class.

 

Students are not permitted to use mobile phones during class time, and all phones should be switched to silent. Teenage students may use their phone to listen to music while working.

 

We do not provide food or snacks during any term classes, except for some holiday program. However, drinking water is always readily available. Throughout term courses no food is permitted in the studio, however during some school holiday programs students are required to bring along a morning or afternoon snack, and a packed lunch if enrolled in a full day session. Due to common allergies we ask that any food students bring to the studio does not contain nuts of any kind (including peanut butter), and seafood (fish, shellfish and crustaceans).

 

6.  Missed classes

No credits or make-up lessons will be given during the current COVID-19, however, you can ask for our online class video recording and learn with it at home.

 

We cannot be held responsible for any changes in work commitments or personal circumstances of parents or students, and we will not issue refunds or transfers for any missed classes.

 

Subject to class availability, we might be able to offer a same-week class swap if you inform us in advance that your child will be unable to attend certain dates, your child is unwell, an unforeseen event occurs, or your child has had to miss a class due to a cancellation by staff. In the event a class is cancelled by staff, we will inform you as soon as we are able to do so.

 

7.  Teachers

We reserve the right to change teachers without notice because of circumstances outside of our control, and we will not issue a refund or transfer if there has been a change in the teacher of a class that you or your child is enrolled in. You agree that students are enrolled to undertake the course and there is no guarantee as to who the teacher will be.

 

8.  Reviewing work made outside of classes

Students may occasionally request their teacher to review work created at home, provided it is related to the content of the class or homework recommended by the teacher.

 

Work that is independent of class content and completed outside of the studio may only be reviewed by appointment, and a tutorial fee of $80 - $100 per hour will be charged depending on the contents and objectives.

 

Students who request a review of work are asked to keep in mind that they are requesting a professional assessment from a professional artist, who is under no obligation to offer encouragement or discouragement, and that it is inappropriate to interpret any remarks regarding their work as personal criticism.

 

9.  Supplies

All materials are provided in our children’s classes however our online students, teenage and adult students are required to bring or purchase their own materials for their course.

 

We offer art material kits to purchase online or at the studio and priced with a student discount and can be picked up at the beginning of the first class or a scheduled delivery. Please contact us if you need a material list emailed to you.

 

 

10.  Photography

We may take photographs of students participating in class or any artwork they create in class and publish them on our website and social media pages, or for other advertising and publicity purposes. If you do not want you or your child and artwork to be photographed, we ask that you inform us before the commencement of the term. Nevertheless, if at any time you request that we remove any images of you or your child and artwork, we will endeavour to do so as soon as possible.

 

11. Personal property

We cannot be held responsible for any personal property you or your child bring onto the premises, and we cannot be liable for any loss or damage to such property. For this reason, we recommend that students do not bring any valuables to class.

 

12. Lost or damaged artwork

We cannot be held responsible for any lost or damaged artwork belonging to students. It is the responsibility of each student to collect their artwork at the end of each term, as any uncollected artwork may be removed or disposed of.

 

13. Medical care

Trained staff will provide basic first aid to the best of their ability in the event of a medical emergency. While we require that you inform staff of any medical conditions or allergies you or your child has, we will not be responsible for the administration of any medicines you or your child needs throughout the class.

 

14. Emergency contact

If you are the parent or guardian of a student, we request that you are registered with your up-to-date and accurate details with us and ensure that you are contactable via your registered details for the duration of each class, in the event of an emergency.

 

15. Disclaimers

While we use age appropriate materials in our classes, you acknowledge that to the extent permitted by law, we cannot be responsible for any damage to your child’s attire or personal property from the use of these materials.

 

While we do everything possible to maintain a high standard of supervision in our classes to ensure the safety of students while they are on our premises, we cannot be responsible for the safety of students outside of classes. You acknowledge that to the extent permitted by law, we are not responsible for the safety of students outside their class time or outside our premises, which is why we ask that all students are collected immediately after their class.

 

16. Feedback

If you have any concerns or comments, please let us know via the “contact us” section on our website, and we will respond as soon as possible.

 

17. Severability

If any part of these terms is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

 

18. Entire agreement

Upon payment of our fees, these terms, as amended from time to time, shall represent the entirety of the agreement between you and us, and any changes must be in writing and agreed to by us to have effect.
